Terms of use
The terms for using the platform, including the scope of the results and Coralia's limitation of liability.
1. Acceptance
These terms govern the use of Coralia Climate Risk, the climate risk assessment platform offered by Coraliae SRL, tax ID (CUIT) 30-71240183-0, with offices at Asunción 2444, 1419, City of Buenos Aires, Argentina ("Coralia").
By creating an account or using the platform, the user accepts these terms and the Privacy policy. Anyone accepting on behalf of a company declares that they are authorized to bind it. If a contract signed between Coralia and the company says otherwise, that contract prevails.
2. What the platform is
The platform is a support tool for assessing the physical climate risk of a company's assets with the Coraliae methodology. It does not replace professional judgement or the engineering, hydrology or insurance studies that each decision may require.
A report being "aligned" with a reporting framework (TCFD, IFRS S2 or another) does not mean that it complies with that framework or that it has been verified under it. Compliance is determined, in each case, by the company, its auditors and the relevant regulator.
3. Accounts and user responsibilities
- Approval. New accounts stay pending until Coralia approves them. The free demo starts on the day of approval.
- Accurate data. Results depend on the data uploaded: asset locations, survey answers and reported measures. The company is responsible for that data being complete, accurate and current, and for having the right to use it.
- Access. Each person uses their own account, keeps their password safe and notifies Coralia if they suspect unauthorized access.
- Company users. The admin decides whom to invite and with what role, and removes access for anyone who stops working with the company.
- Reviewing results. Before publishing, presenting or using a result to make decisions, the company reviews it and validates it with its professionals.
4. Scope of the results
The platform's results are risk estimates, not predictions: Coralia does not guarantee that a climate event will or will not happen, or its intensity, and is not liable for the losses an event may cause.
- Climate projections. Future hazards are estimated with regional climate models (CORDEX-SA) under emissions scenarios (SSP2-4.5 and SSP5-8.5) and carry the uncertainty inherent to those models.
- Historical data. Observed trends depend on the availability and quality of third-party station series and reanalysis datasets.
- Index and measures. The risk index and the prioritization of measures apply the Coraliae methodology to the uploaded data; they do not replace a detailed study of each site.
- Artificial intelligence. Coral-IA can make mistakes. Its answers are guidance and the company must check important data.
- Coralia review. Support from Coralia consultants is a technical review, not a certification by an accredited body. [Scope to be confirmed.]
- Company decisions. Investments, insurance, works or public statements the company decides on based on the results are the company's sole responsibility.
- Not legal advice. The platform does not provide legal, accounting, financial or regulatory advice.
5. Limitation of liability
To the extent permitted by law, Coralia's total liability to a company is limited to what that company paid for the platform in the 12 months before the event giving rise to the claim.
- Coralia is not liable for indirect damages, such as lost profits, lost business, damage to assets from climate events, fines, penalties or reputational harm.
- Coralia is not liable for third-party provider failures or for interruptions beyond its reasonable control.
- These limitations do not apply in case of wilful misconduct or gross negligence by Coralia, or to whatever the law does not allow to be limited.
6. Ownership of the data and the platform
- Company data. The company retains ownership of its data, assessments and reports, and authorizes Coralia to use them only to provide the service.
- Aggregated data. Coralia may use aggregated, anonymous data to improve the platform and the methodology.
- The platform. The software, design, trademarks, the Coraliae methodology and the processed climate layers belong to Coralia or its licensors.
- Third-party data. Some layers come from public or third-party datasets with their own licenses: they can be used within the platform and in reports, but not extracted or redistributed.
7. Plans and cancellation
- Demo. Each approved company has a free 7-day demo with the limits shown on the platform.
- Plans and prices. They are shown on the platform or in the commercial proposal. Plan changes are requested from the platform and approved by Coralia. [Payment method to be confirmed.]
- Price changes. They are announced at least 30 days in advance and apply from the next period.
- Non-payment. Coralia may limit access to paid features after notifying the company. [Conditions to be confirmed.]
- Cancellation. The company can cancel at any time and first request a copy of its assessments at contacto@coraliae.com.
- Suspension for misuse. Coralia may suspend an account that breaches these terms, stating the reason, except in a security emergency.
8. Acceptable use
It is not allowed to:
- Try to access other companies' data or parts of the platform without authorization.
- Test or attack the platform's security without Coralia's written authorization.
- Upload false information to obtain misleading reports, or to back risk or adaptation statements known to be untrue.
- Upload content without the right to use it, malicious software or sensitive personal data.
- Copy, resell or redistribute the platform, the methodology or the climate layers.
- Extract data with automated programs.
9. Availability and changes
- Availability. Coralia makes reasonable efforts to keep the platform available, but does not guarantee that it will work without interruptions or errors.
- Changes to the service. If a change removes an essential feature of the contracted plan, it is announced at least 30 days in advance.
- Changes to these terms. Admins are notified by email at least 15 days in advance. Continuing to use the platform after that date means accepting the new version.
10. Governing law and contact
These terms are governed by the laws of the Argentine Republic. Any dispute is submitted to the ordinary courts of the City of Buenos Aires. If any part of these terms is held invalid, the rest remains in force.
